About

Ashish is Associate Partner at the firm who handles international and  domestic disputes with special focus on Insurance & Reinsurance, Infrastructure, Construction, Oil & Gas, Energy and Civil & Commercial disputes. Ashish has extensive experience in dealing with cross border contentious and non‐contentious disputes. He has advised and represented his clients in domestic and international arbitration in various jurisdictions including UK, the US, Dubai, Singapore, Hong Kong under various Institutional Rules and ad‐hoc arbitrations. Ashish is well‐recognised in the Insurance Industry and in commercial arbitrations. He has successfully represented Indian and Foreign clients before various forums including the Supreme Court, High Courts and Arbitral Tribunals. He has been a part of some of the complex and high-stake Insurance claims. He is a member of the Young International Council for Commercial Arbitration, Young Singapore International Arbitration Centre as well as Delhi High Court Bar Association.

Representative matters

  • Vizhinjam International Seaport Ltd (VISL) [A Government of Kerala Entity] advised and represented VISL on Adani Vizhinjam Port Private Limited’s claim for extensions of the project on account of various Force Majeure Events. The project is India’s first Deepwater Multipurpose Seaport.
  • Transaction Solutions International (India) Private Limited advising and representing TSIL in an ad hoc arbitration relating to recovery of money.
  • ONGC Nile Ganga advising and representing ONGC in relation to dispute under EPSA and in an International Commercial Arbitration under the ICC Rules.
  • Mytrah Energy Private Ltd advised and represented Mytrah in relation to dispute under the commercial agreements for generation of solar energy in an ad hoc arbitration.
  • Airgate advised and represented the client in relation to dispute under the shareholder’s agreement in an International Commercial Arbitration under the SIAC Rules.
  • ACME Solar Holding Limited advising and representing them in relation to dispute under the Securities Purchase Agreement and recovery of holding amount in an ad-hoc arbitration.
  • Oil Refinery Company: Advised under the All-Risk Policy with BI loss. Explosion occurred at the Insured’s oil refinery and a claim was notified. Prepared the coverage analysis report. Participated in meetings with the Insurer/Insured/broker. Drafted the settlement agreement and subrogation deed.
  • Steel Manufacturer: Advised under the CMRP and Terrorism policy. Claim for material damage and BI was made pursuant to damage to the property. Reviewed the proposal form, underwriting file. Prepared coverage analysis report. Periodic update to the client.
  • Oppression & Mismanagement: Advised under the D&O policy. The Chairman was sacked from the company which led to litigations before various forums. Reviewed the court pleadings to analyse the coverage under the policy. The issue on allocation was addressed. Several rounds of discussions with the Insurer/Insured/broker to discuss the concerns in relation to defence costs.
  • IT Company: Advised under the D&O policy. The directors of the company were implicated in several civil and criminal litigation. Reviewed reports of several agencies like SFIO, CBI chargesheet, ICAI report etc and prepared coverage reports. Assisted in appointment of defence counsel and was closely monitoring the court proceedings. Prepared update reports capturing the developments and setting out strategies for the litigation and commenting on the defence costs being incurred.
